1. The agreement
These Terms of Service ("Terms") are an agreement between you and My Vet Hub, Inc. ("My Vet Hub", "we", "us"). PayRoamer is an app from My Vet Hub, Inc.. These Terms cover the PayRoamer app for iPhone and the website at payroamer.com (together, the "Service"). By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.
If you use the Service for a business, you accept these Terms on its behalf and confirm that you are allowed to. "You" then means that business.
Our Privacy Policy explains how we handle personal information.
2. Who can use PayRoamer
- The Service is for businesses, not for personal, family or household use
- You must be at least 18 and able to enter into a contract
- Card payments are offered to businesses in the United States that our payment service provider has verified
3. Accounts and staff
- Give accurate information when you sign up and keep it up to date
- Keep your password and your device secure. You are responsible for what happens under your account, including what your staff do with the logins you give them
- Tell us promptly if you think someone has used your account without permission
- The business type you choose sets how the register works. Once a business is approved for live payments, the type cannot be changed without a new verification
4. Payments and Stripe
Card payments in the Service are processed by Stripe. To accept them you must complete Stripe's verification and accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Stripe, not My Vet Hub, holds and moves the money and pays out to your bank account.
- My Vet Hub is not a bank, a money transmitter or a payment processor, and does not hold your funds
- Stripe decides whether to approve a business, and Stripe or a card network may decline, hold, reverse or limit a payment or payout
- You are responsible for refunds, chargebacks, disputes and any amounts owed to Stripe in connection with your sales
- Cash sales you record in the app are records only; no money moves through the Service
- Accepting contactless payments on an iPhone is also subject to the terms Apple and Stripe set for that feature
5. Fees
The app is free to download. Card payments carry processing fees, which may include a platform fee charged by My Vet Hub and taken from each card payment. We will tell you the fees that apply to your account, and we will give notice before changing them. Fees are not refundable unless the law requires it. You are responsible for any taxes on the fees.
6. Your responsibilities
- Your sales. You are the seller. You are responsible for the goods and services you sell, your prices, your receipts and your dealings with your customers
- Tax. The app works out sales tax from the settings you choose for each item and each sale. You are responsible for choosing the right settings and for collecting, reporting and paying the correct tax. We do not give tax advice
- Tips. You are responsible for handling tips in line with the law
- Records about people. If you keep customer, client or pet records in the app, you are responsible for having the right to do so and for telling those people how you use their information. The Service is a point of sale, not a medical or veterinary record system
- The law. You must follow the laws and card network rules that apply to your business
7. Acceptable use
You must not:
- Use the Service for anything illegal, fraudulent or deceptive, or for a business Stripe prohibits
- Take a payment that is not for a genuine sale of goods or services, or pay yourself with your own card
- Try to store card numbers, or enter card details anywhere other than the payment screen
- Copy, modify, reverse engineer or resell the Service, except where the law allows it despite this restriction
- Interfere with the Service, probe it for weaknesses without our written permission, or get around its security or limits
- Use the Service to build a competing product
8. Your data
The items, orders and records you enter are yours. You give us permission to host, copy and process them as needed to provide the Service to you. You can delete your account, and with it your business data, in the app at any time; the support page explains how.
9. Our service and property
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your business while these Terms apply. We and our licensors own the Service, including its software, design and the PayRoamer name and logo. If you send us feedback, we may use it without owing you anything.
We may change, add or remove features, and we may suspend the Service for maintenance or security. We will try to give notice of changes that significantly reduce what the Service does.
10. Apple and other third parties
The app is distributed through Apple's App Store. These Terms are between you and My Vet Hub, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also follow the App Store terms.
The Service depends on services from others, including Stripe and Apple. We are not responsible for those services or for their being unavailable.
11. Ending the agreement
- You can stop using the Service and delete your account at any time
- We may suspend or close an account that breaks these Terms, puts us, Stripe or other users at risk, or where the law or Stripe requires it. Where we reasonably can, we will tell you first
- Ending the agreement does not cancel payments already made or amounts already owed, and sections that by their nature should continue will continue
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that every payment will be approved, or that tax or other calculations will be right for your circumstances.
13. Limit of liability
To the fullest extent the law allows, My Vet Hub will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the Service is limited to the greater of the fees you paid to My Vet Hub in the twelve months before the claim arose and one hundred US dollars.
Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
You will defend and indemnify My Vet Hub against claims, losses and costs, including reasonable legal fees, that arise from your business, your sales, your data, or your breach of these Terms or of the law.
15. Changes
We may update these Terms. The effective date at the top shows when they last changed. We will give account holders notice in the app or by email before a material change takes effect. If you keep using the Service after that, you accept the new Terms; if you do not agree, stop using the Service and delete your account.
16. General
- These Terms, with the Privacy Policy, are the whole agreement between you and us about the Service
- If part of these Terms cannot be enforced, the rest still applies
- If we do not enforce a term, that is not a waiver of it
- You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of the business
- These Terms are governed by the laws of the United States and of the state in which My Vet Hub has its principal place of business, without regard to conflict-of-law rules. Disputes will be heard in the courts located there, unless the law gives you the right to bring them elsewhere
